Article II - General Plan, Reservations, Exceptions, Easements and Dedications

  • Section 2.1 - GENERAL PLAN AND DECLARATION - This Declaration is established pursuant to and in furtherance of a common and general plan for the improvement and sale of Lots within the Subdivision and for the purpose of enhancing and protecting the value, desirability, and attractiveness of the Subdivision. Every Lot in the Subdivision and each part thereof shall be owned, held, transferred, conveyed, sold, leased. rented, hypothecated, encumbered, used, occupied, maintained, altered and improved subject to the covenants, conditions, restrictions, limitations, reservations, easements, and other provisions set forth in this Declaration, for so long as the provisions of this Declaration remain in effect. All Lots in the Subdivision shall be subject to the jurisdiction of the Association.
  • Section 2.2 - PLAT - All dedications, limitations, restrictions and reservations shown on the Plat are incorporated herein, and shall be construed as being adopted in each and every contract, deed or conveyance executed or to be executed by or on behalf of any subsequent seller, conveying said property and or any part thereof, whether specifically referred to therein or not.
  • Section 2.3 - EASEMENTS - Easement for the installation and maintenance of utilities, drainage facilities, roads, streets and pipeline easements heretofore granted are reserved as shown on the recorded Plats.
