RESTATED AND AMENDED DECLARATION OF COVENANTS, CONDITIONS, AND RESTRICTIONS

SUBDIVISIONS IN HARRIS COUNTY

COUNTY OF HARRIS


WHEREAS, M.T. - WEST, INC., PASADENA GARDENS DEVELOPMENT CORPORATION, JACKSON LAND COMPANY, INC., EVELYN LEE, THOMAS G. RUSSELL and WIFE, MARILYN G. RUSSELL, CHARLES F.REINHARDT and WIFE, SHARON ANN REINHARDT, GEORGE M. HAIL, JR.and WIFE, GETTY 1.HAIL, MICHAEL MCCALEB and WIFE, MARY ANN MCCALEB, HARRY B. TERRY and WIFE VIRGINIA LEE TERRY, ("Declarant") were owners of certain property known as Bellaire West, Section One (1) located in Harris County, Texas, according to the map or plat thereof recorded in Volume 129, Page 50 of the Map Records ofHams County, Texas; and


WHEREAS, M.T. - WEST, INC., and FIRST GENERAL REALTY CORPORATION, ("Declarant") were the owners of certain properties known as Bellaire West, Section Two (2) and Bellaire West, Section Three (3), both located in Hams County, Texas, according to the maps or plats thereof recorded in Volume 135, Page 55, and Volume 135, Page 62 of the Map Records of Harris County, Texas, respectively; and


WHEREAS, AIC CORPORATION, a Delaware Corporation, ("Declarant") was the owner of certain properties known as Bellaire West, Section Four (4) and Bellaire West, Section Seven (7), both located in Harris County, Texas according to the maps or plats thereof recorded in Volume
147, Page 65, and Volume 149, Page 1, of the Map Records of Harris County, Texas, respectively; and


WHEREAS, AIC REALTY CORPORATION, a Texas Corporation ("Declarant"), was the owner of certain property known as Bellaire West, Section Five (S), located in Hams County, Texas according to the map or plat thereof recorded in Volume 148, Page 149, of the Map Records of Harris County, Texas; and


WHEREAS, Norwood Homes, Inc. ("Declarant") was the owner of certain property known as Bellaire West, Section Six ( 6 ) , located in Harris County, Texas according to the map or plat thereofrecorded in Volume 151, Page I23oftheMapRecordsofHamsCounty,TX;and


WHEREAS, CRC-Crose, International Inc., a Texas Corporation, ("Declarant") was the owner of certain property known as Bellaire West, Section Eight (8). located in Hams County, Texas, according to the map of plat thereof recorded in Volume 151, Page 123 of the Map Records ofHarris County, Texas; and

WHEREAS, by that certain instrument recorded in the Official Public Records of Harris County, Texas, under County Clerk's File No. C123371 and Film Code Number 034-23-0628 et seq., Declarant imposed on all Lots within Bellaire West, Section One (I), all those certain covenants, conditions, restrictions, easements, charges, and liens set forth therein; and


WHEREAS, by that certain instrument recorded in the Official Public Records of Harris County, Texas, under County Clerk's File No. C247637 and Film Code Number 046-40-0453 et seq., Declarant imposed on all Lots within Bellaire West, Section Two (2), all those certain covenants, conditions, restrictions, easements, charges, and liens set forth therein; and


WHEREAS, by that certain instrument which was recorded in the Official Public Records of Harris County, Texas, under County Clerk's File No. C2S2006 and Film Code Number 047-29-0736 et seq.. Declarant imposed on all Lots within Bellaire West, Section Three (3), all those certain covenants, conditions, restrictions, easements, charges, and liens set forth therein; and


WHEREAS, by that certain instrument recorded in the Official Public Records of Harris County, Texas, under County Clerk's File No. CS12142 and Film Code Number 074-30-0631 et seq., Declarant imposed on all Lots within Bellaire West, Section Four (4), all those certain covenants, conditions, restrictions, easements, charges, and liens set forth therein; and


WHEREAS, by that certain instrument recorded in the Official Public Records of Harris County, Texas, under County Clerk's File No. C604896 and Film Code Number 084-24-1195 et seq, Declarant imposed on all Lots within Bellaire West, Section Five (S), all those certain covenants, conditions, restrictions, easements, charges, and liens set forth therein; and


WHEREAS, by that certain instrument recorded in the Official Public Records of Harris County, Texas, under County Clerk's File No. C977612 and Film Code Number 108-39-2042 et seq., Declarant imposed on all Lots within Bellaire West, Section Six (6), all those certain covenants, conditions, restrictions, easements, charges, and liens set forth therein; and


WHEREAS, by that certain instrument recorded in the Official Public Records of Hams County, Texas, under County Clerk's File No. C605520 and Film Code Number 084-26-0208 et seq., Declarant imposed on all Lots within Bellaire West, Section Seven (7), all those certain covenants, conditions, restrictions, easements, charges, and liens set forth therein; and


WHEREAS, by that certain instrument recorded in the Official Public Records of Harris County, Texas, under County Clerk's File No. C829168 and Film Code Number 100-27-2036 et seq., Declarant imposed on all Lots within Bellaire West, Section Eight (8), all those certain covenants, conditions, restrictions, easements, charges, and liens set forth therein; and


WHEREAS, Paragraph 1, under the General Provisions section in each set of Restrictions for Bellaire West, Sections One (1). through Eight (a), provides that the Restriction for Bellaire West, Sections One (1) through Eight (8). respectively, may be amended during the first forty (40) year period after recording by an instrument signed by not less than a majority of the then owners of the lots within such section of Bellaire West and duly recorded in the Real Property Records of Harris County, Texas; and

WHEREAS, the undersigned, being at least fifty-one percent (51%) of the owners of Lots in each of the eight (8) sections of Bellaire West, desire to amend the restrictions applicable to each section of Bellaire West and, at the same time, consolidate all eight (8) sections of Bellaire West into a comprehensive set of uniform covenants, conditions and restrictions;


NOW, THEREFORE, the undersigned, being at least fifty-one percent (51%) of the Owners of Lots in each of the eight (8) sections of Bellaire West, do hereby restate and amend the restrictions for Bellaire West, Sections One (1) through Eight (8), to be governed by the covenants, conditions and restrictions set forth in this instrument.
